Terms of Service

1. Acceptance

These Terms of Service (“Terms”) govern your access to and use of the Adamantite LLC website and any datasets, dashboards, calculators, tools, or content made available through it (collectively, the “Site”). By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Who we are

The Site is operated by Adamantite LLC, a Wyoming limited liability company (“Adamantite,” “we,” “us”). The company is domiciled in the State of Wyoming with its principal place of business maintained remotely. Our registered agent and legal address are in Wyoming.

References on the Site to “Adamantite Analytics” or specific product names refer to product lines within Adamantite LLC, not separate legal entities.

3. Use of the Site

• You will not use the Site in violation of any applicable law.
• You will not attempt to interfere with, disrupt, reverse engineer, or circumvent the security or rate-limiting of the Site.
• You will not scrape, mass-download, or republish substantial portions of Site content without our written permission, except where the content is published by us under an explicit open license.
• You will not impersonate another person or submit information you do not have the right to provide.

4. Accounts

You are responsible for activity that occurs under your account, for maintaining the confidentiality of your credentials, and for ensuring that the information you provide is accurate. We may suspend or terminate accounts that violate these Terms.

5. Consulting and paid services

Custom consulting, web development, analytics, and other paid services are governed by a separate written agreement (statement of work, engagement letter, or client services agreement) executed between Adamantite LLC and the client. Nothing on the Site constitutes an offer of paid services on specific terms; references to services and pricing ranges are informational only. Scope, deliverables, timeline, payment terms, intellectual property assignment, and warranties are defined in the written agreement, not on the Site.

Adamantite LLC does not provide legal, tax, accounting, or regulated financial advice through its consulting services. Any financial analysis or operational recommendations delivered through paid services are for informational and planning purposes only and do not replace qualified professional advice.

6. Datasets, dashboards, and tools — no warranty

The Site is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, or quiet enjoyment. We make commercially reasonable efforts to keep data accurate and pipelines operational, but we do not guarantee that any dataset, calculation, model output, or tool is free of errors or fit for any particular use.

7. Not financial, legal, tax, or professional advice

Content on the Site — including the Pokémon TCG Market section, ETF indexes, expected-value rankings, gas-bill estimates, energy-demand forecasts, business-formation data, crime-map data, and any consulting, analytical, or advisory content — is provided for informational and educational purposes only. It does not constitute financial, investment, legal, tax, real-estate, utility-billing, or other professional advice. You should not rely on it as the basis for any decision. Consult a qualified professional before acting.

Any recommendations, analyses, or strategies discussed through Adamantite’s consulting services are specific to the client’s disclosed circumstances at the time of engagement. Past performance of any analyzed strategy or tool does not guarantee future results. Adamantite LLC does not guarantee specific business outcomes, revenue increases, search rankings, or other performance metrics.

The Pokémon TCG “market” section uses financial market terminology (“ETF,” “index,” “gainers,” “returns”) for analytical convenience. The instruments described are not securities, are not registered with any regulator, and are not offered for sale. No investment is being solicited or facilitated.

8. Third-party data and trademarks

The Site incorporates data sourced from third parties, including but not limited to: the Pokémon TCG API, JustTCG, U.S. Energy Information Administration, Open-Meteo, NOAA, NYC Open Data, NYS Department of State, NYS ORPTS, U.S. Census Bureau, and others. Each source remains subject to its own terms of use and license. We do not warrant the accuracy of third-party data.

Pokémon and all related marks, characters, and card imagery are trademarks of Nintendo, Creatures Inc., GAME FREAK inc., and/or The Pokémon Company. Adamantite LLC is not affiliated with, endorsed by, or sponsored by any of these entities.

National Fuel Gas Company and related marks are trademarks of National Fuel Gas Company. The WNY Gas Bill Calculator and related forecast tools are independent analytical projects and are not affiliated with, endorsed by, sponsored by, or providing utility billing on behalf of National Fuel Gas Company or any local distribution company.

All other trademarks, logos, and brand names referenced on the Site are the property of their respective owners and are used for identification purposes only.

9. Our intellectual property

The Site's original code, written analysis, methodology, brand elements, and original visualizations are the property of Adamantite LLC and are protected by copyright and other intellectual property laws. Datasets we publish under an explicit open license are governed by that license. Otherwise, no rights are granted to reproduce, distribute, or create derivative works from Site content without our written permission.

10. User-submitted content

When you submit content through the Site (for example, a community ETF proposal or a contact-form message), you grant us a non-exclusive, royalty-free, worldwide license to host, display, and use that content as necessary to operate the Site and respond to you. You represent that you have the right to submit the content and that it does not violate any law or third-party right.

11. Limitation of liability

To the fullest extent permitted by Wyoming law, Adamantite LLC, its member, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any consulting or paid services referenced on the Site — whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or related to the Site or any services shall not exceed one hundred U.S. dollars (US$100), or the amount you paid us for the relevant service in the twelve months preceding the claim, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Adamantite LLC and its member from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your violation of applicable law, or your infringement of any third-party right.

13. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising under these Terms is the state or federal courts located in Laramie County, Wyoming, and you consent to their jurisdiction. Adamantite LLC is a Wyoming entity and this choice of law reflects the parties’ reasonable expectations.

14. Changes

We may update these Terms from time to time. The “Effective” date at the top reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
